Acceptance of Terms and Conditions

By accepting the proposal for work and hiring NXT Level Smart Home as your contractor, you acknowledge and agree to be bound by the terms and conditions set forth in this document, as well as our Terms of Use and Privacy Policy:

These terms constitute a legally binding agreement between you (the Client) and NXT Level Smart Home. Your acceptance of our proposal signifies your full and voluntary consent to adhere to these terms throughout the duration of our contract.

Fees and Policies

• Reschedule Fee: $250 per instance if not notified at least 3 business days in advance.

• Product Sales: All product sales are final unless otherwise communicated in writing.

• Returned Check Fee: $35

• Credit Card Transactions: 3% processing fee applies.

• Payment Terms: Full payment is due within 24 hours of project completion. Minor changes pending do not constitute an incomplete project.

• Late Payment Fee: 1% daily on outstanding balances after 3 days past due.

Limited Service & Installation Warranty

Coverage Duration
30 days from project completion or installation.

Additional Coverage
This warranty is in addition to any manufacturer’s warranty.

What Is Not Covered

1. Defects apparent but not reported.

2. Damage from misuse, unauthorized alterations.

3. Damage from natural disasters or accidents.

4. Failure to follow installer or manufacturer instructions.

Remedies & Limitations

• A service call fee applies for troubleshooting non-NXT equipment.

• No compensation for incidental, consequential, or emotional damages.

• No compensation beyond the total contract value.

• No coverage of attorney fees or costs.

Enforceability
Subject to the laws of the State of Texas.

Voided Warranty Conditions

• Work not included in the signed proposal.

• Final project payment not made.

Service Calls
A service fee of $179.99/hr applies when:

1. The 30-day warranty has expired.

2. The issue is found to be caused by user error or tampering.

Project Delays
If delays are caused by the client, you are responsible for:

• Receiving equipment deliveries.

• Paying for completed work.

We will reschedule as available.

Record Keeping
Please retain this warranty document and related records.

Compliance with Texas Law
This agreement is governed by the laws of the State of Texas.

Dispute Resolution
Issues will be resolved via mediation or arbitration under Texas law.

Definitions

• Client: Individual or entity hiring NXT Level Smart Home.

• NXT Level Smart Home: Service provider and contractor.

• Proposal: Project scope, pricing, and specifications.

• Services: Work and installations performed under agreement.

• Workmanship: Quality of labor per industry standards.

• Manufacturer’s Warranty: Product-specific warranties from manufacturers.

• Reschedule Fee: $250 when 3-day notice not given.

• Returned Check Fee: $35

• Credit Card Processing Fee: 3% of the transaction.

• Warranty Period: 30 days from project completion.

• Project Delays: Delays not caused by NXT Level Smart Home.

• Voided Warranty: Circumstances nullifying the warranty.

• Texas Law: Governing jurisdiction for this agreement.
